A jury in Washington has ruled that a hospital must pay $4.25 million to the family of a girl born with cerebral palsy after she suffered severe brain damage during the delivery process. The jury ruled that the girl’s cerebral palsy symptoms were caused by the negligence of employees of Evergreen Hospital Medical Center.

Doctors have begun using botox injections—normally used for easing wrinkles—to treat the symptoms of some patients with cerebral palsy. By injecting the treatment into muscles that are affected by cerebral palsy symptoms, doctors hope that they can give patients greater mobility and allow them to increase their control of muscles that are affected by the condition.

An Erb’s palsy lawsuit has been filed in Illinois by the mother and father of a girl born with a brachial plexus injury. Christy and Dennis Hartmann contend that Dr. Diana Peterson, who performed the delivery, was negligent in that she failed to use proper delivery methods for their daughter, Chrisden. Thus the girl, who is now three years old, suffered a brachial plexus injury.
